Terms of Service
Effective 7 October 2026 · Version 2026-10-07-connected-accounts
1. Who we are and these terms
Design Factory is operated by Jomoj LTD, trading as Design Factory (“Design Factory”, “we”, “us” or “our”). Our address is 56 Parkside Drive, Edgware, HA8 8JX, England. You can contact us at support@designfactory.app. Our website is designfactory.app.
These Terms apply when you create an account or use the Design Factory website and app, including its design, idea, image-processing and design credit features (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Your account
Where free registration is offered, you can create an account using Google or a verified email code. You must sign in before generating ideas or designs or completing a new account purchase. New verified accounts receive a signup design credit allowance once, shown in the app and separate from purchased design credits. Existing customers can continue to log in; their workspace, history and remaining design credits stay available, including when design credits run out. If you previously paid through guest checkout, verify the email used for that purchase and finish account setup, or link the purchase to your existing account with the same verified email.
If you are under 18, you need permission from a parent or guardian who agrees to these Terms. You must meet any minimum age required by applicable law. You must provide accurate account information, keep your sign-in details secure and use your own account. You are responsible for activity carried out through your account, except where applicable law says otherwise. Contact us promptly if you believe someone has used your account without permission.
You may use the Service only where doing so is lawful. You must not use it to violate another person’s rights, upload content you do not have permission to use, interfere with the Service or its security, or attempt to access another person’s account or information.
3. The Service and AI-assisted results
The Service lets you create and manage design ideas and artwork, process images, and use AI-assisted features. Results are generated or processed from the instructions, files and settings you provide. Results can vary and may contain mistakes or unwanted elements. Review each result and make sure it is suitable for your intended use before relying on, publishing or selling it.
We may maintain, change or improve the Service. We will not use customer content to train AI models. The Service sends prompts and related inputs to OpenAI to provide AI features. The Privacy Policy explains how information is handled to provide and secure the Service, including by those providers.
Optional name and age details can be skipped and edited in Settings.
4. Your content and generated results
You remain responsible for the content, images, text, prompts and other material you submit (“Your Content”), including having the rights and permissions needed to submit it and ask us to process it. You give us permission to host, copy, transform and process Your Content only as needed to operate, secure and support the Service and return results to you. This permission ends when the relevant content is deleted or your account is deleted, except where we must retain information for legal, security, financial or backup purposes as described in the Privacy Policy.
As between you and Design Factory, you retain your rights in Your Content and own the generated results to the extent permitted by law. You may use results commercially, including for print-on-demand products and client work, on free and paid plans. We do not claim ownership of your artwork. These permissions do not give you rights to third-party material or override an AI provider’s applicable terms. We do not promise that a result is unique, copyrightable, cleared for use, or free of third-party rights. You are responsible for checking that your intended use is lawful and does not infringe someone else’s rights.
5. Plans, trials and payments
Current plan names, features, billing intervals, prices, discounts and included design credits are shown on the membership page and at checkout. We may change the offers available for future purchases. The offer displayed and accepted at checkout records the price, billing interval and design credit entitlement for that purchase. A later change to the public catalogue does not silently change an existing member’s agreed price or design credit entitlement.
An eligible account may purchase the one-time introductory design credit offer for $1 USD. The current design credit amount is shown before purchase. This is a one-time payment, with no subscription or automatic renewal. Design credits are added only after confirmed payment and verified account eligibility. The offer is available once per account across eligible payment methods; earlier introductory or historical welcome allowances count towards this limit. A refund does not renew eligibility. Earlier introductory purchases retain the amount and conditions recorded at their checkout. Your account stays open when design credits run out; obtaining more design credits requires an explicit design credit-pack or membership purchase. Paid membership trials are not currently offered. Any future trial offer must show its terms, design credit allowance, first payment amount and date, and cancellation deadline before acceptance.
Memberships may be offered monthly or annually. The total price, interval, discount and design credit schedule will be shown before purchase. Annual memberships are billed yearly, with included design credits granted monthly. Unused design credits roll over and remain available after cancellation. One-time design credit packs are charged once and do not create a subscription. Payments are processed by Stripe or another payment provider identified at checkout; that provider’s payment terms also apply to the payment itself.
You authorize the payment provider to charge the displayed price and applicable taxes using your selected payment method. Any tax treatment and tax-inclusive/exclusive display must match the checkout information and applicable law.
6. Membership changes and cancellation
You can manage or cancel recurring membership through the billing controls linked from your account. Cancellation stops the next renewal; it does not erase design credits already in your account. Paid membership features continue through the period already paid for. When a membership ends or a renewal is not paid, the account remains open without an active membership and no further membership design credits are granted. You may continue using your remaining design credits for eligible design credit-using work while your account remains available.
An upgrade takes effect immediately at the full price of the new membership shown at that time and starts a fresh billing period. Design credits already remaining stay in your account. A downgrade takes effect at the next renewal; your current membership terms continue until then.
7. Design credits
Design credits are units used for eligible actions inside the Service. Before you confirm a chargeable action, the Service shows its design credit cost. The available action costs and design credit offers can change for future use or purchases and are controlled through the current offer and Admin configuration.
Design credits:
- do not represent money, have no cash value, cannot be withdrawn or exchanged for cash, and cannot be transferred to another account or used to pay for a membership;
- do not expire and roll over while your account remains available, including after a membership ends;
- remain available after a membership ends, including without an active membership; and
- are usable only for the eligible Service actions shown in the app.
One-time design credit packs may be purchased after signing in or creating a verified account. The amount and price are shown before purchase. Pack design credits are added after confirmed payment and verified account setup, and do not expire.
If a payment is refunded, the unused design credits associated with that refunded purchase are removed. Design credits already spent are not clawed back from other design credit balances and do not create a negative balance. This section does not remove any refund or cancellation right that applicable law gives you.
The introductory design credit purchase is available once per account across eligible payment methods. The current amount and price are shown before purchase. Earlier introductory purchases count towards this limit, and a refund does not renew eligibility. See our Design Credit Policy.
8. Refunds and billing questions
If you have a billing question or want to ask us to review a payment, contact support@designfactory.app with the account email and payment details (do not send full card numbers). Cancelling a membership stops a future renewal but does not by itself refund a payment already made. We offer a voluntary refund when you contact us within 14 days of purchase and have not used the purchased design credits or paid service. We review requests involving used purchases individually, including service failures or billing mistakes. This voluntary policy does not limit statutory cancellation, refund or other consumer rights. If we issue a refund, the related unused design credits are removed as described above. Mandatory consumer rights and any refund or cancellation rights that apply to you remain unaffected.
9. Account deletion and ending access
You can request account deletion through the account controls where available. Deletion removes or disconnects account data as described in the Privacy Policy, subject to information we must keep for legal, security, payment, accounting or dispute purposes. Deleting an account removes access to the Service and any design credits left in that account; design credits cannot be transferred to another account. Contact support if you need help before deleting an account.
We may restrict or suspend access where reasonably necessary to protect the Service, customers or third parties, respond to unlawful activity, or address a serious breach of these Terms. We will follow applicable law and provide information or a route to contact us where appropriate.
10. Availability and responsibility
We work to keep the Service available, but it may be interrupted for maintenance, security, provider outages or other operational reasons. We do not promise uninterrupted access or that every AI-assisted result will meet your requirements. Nothing in these Terms excludes or limits a responsibility or consumer right that applicable law does not allow us to exclude or limit.
No waiver of mandatory consumer rights is intended.
11. Changes to these Terms
We may update these Terms when the Service, law or our operating practices change. We will publish the updated version with its effective date and give notice where required. A change will not retroactively rewrite the price or design credit entitlement recorded for an existing purchase. If you continue using the Service after an update takes effect, the updated Terms apply to future use to the extent permitted by law.
12. Governing law and disputes
These Terms are governed by the law of England and Wales. Subject to mandatory consumer rights, the courts of England and Wales have jurisdiction. Please contact support first so we can try to resolve a dispute. Nothing in these Terms prevents a consumer from relying on mandatory protections or bringing a claim in a court that applicable law allows.
13. Contact
For account, privacy or billing support, contact support@designfactory.app or use /support. Privacy requests are also described in the Privacy Policy.
